I realize legal definitions may differ from my definition of responsibility. I also recognize that the dog owner is also responsible for the child being allowed to hug her dog. However, the child may have acted before the dog owner could pull the dog away or say no. I teach children to never hug or kiss a dog or get his or her face near a dog. I also teach them other components of bite prevention, such as not approaching an unknown dog, and asking permission to pet a dog. Parents are responsible for this education, as well. Unfortunately, most bites occur by family dogs or dogs known to the child, and parents allow unsafe behavior that has a high potential for dog bites. Whenever children are in the home, I involve them in this education, and I make sure my clients know how to safely allow their dogs to meet other dogs and people. I wish all dog owners and all parents were equipped with this information.
Wed, 06 Sep 2017 17:14:34 -0500 http://www.callgentry.com/blog/entry/3792939/strict-liability-for-dog-bite-in-missouri#comment4377909 /blog/entry/3792939/strict-liability-for-dog-bite-in-missouri#comment4377909 Uninsured Injured Drivers are Barred from Collecting All Damages - Chip Gentry
Pat, you raise some fantastic points. We certainly understand what the legislature was trying to accomplish and create an additional legislative incentive to encourage folks to obtain proper insurance. If they fail to do so, they are precluded from otherwise recovering for their damages. As you point out, it appears, as is often the case, the new legislation does not cover all the circumstances where someone may be injured in a car wreck.
Tue, 28 Jan 2014 13:46:20 -0600 http://www.callgentry.com/blog/entry/3704034/uninsured-injured-drivers-are-barred-from-collecting-all-damages#comment4203279 /blog/entry/3704034/uninsured-injured-drivers-are-barred-from-collecting-all-damages#comment4203279 How to Succeed in Private Practice - Tip #2 - Chip Gentry
Thanks Pat! You believe your company is current on its fleet policy, but it has lapsed. Additionally, your company files bankruptcy (Chapter 7) the day a drunk driver hits you and paralyzes you from the neck down, and during all times surrounding or connected in any way to the event of the crash you were diligently obeying all the various and sundry rules of the road? Additionally, the drunk driver is very, very wealthy.
You only get lost wages and medical bills?
If so, is this not a travesty of justice?
As a Mid Missouri born citizen now residing in Arizona, I am concerned.
Pat
Wed, 23 Oct 2013 18:28:57 -0500 http://www.callgentry.com/blog/entry/3704034/uninsured-injured-drivers-are-barred-from-collecting-all-damages#comment4198197 /blog/entry/3704034/uninsured-injured-drivers-are-barred-from-collecting-all-damages#comment4198197 How to Succeed in Private Practice - Tip #2 - Pat Dickson
Chip,
I agree becoming an expert is one of the secrets.
Right out of law school a still-practicing 85 year old lawyer gave me this tip.
He said go learn something really discrete through and through and write legal articles about it. In no time you'll double your hourly rate.
I didn't listen to him, so I went into general practice and dabbled with a bit of everything.
It was not until I went back to school for an MS in Information Technology I finally understood the advice. I quickly discovered knowing all the ins and outs of software licensing doubled my pay. Plus, it was nice to just focus in one area.
I love the web site.
You have a great firm!
Pat
Wed, 23 Oct 2013 17:43:50 -0500 http://www.callgentry.com/blog/entry/3703361/how-to-succeed-in-private-practice-tip-2#comment4198196 /blog/entry/3703361/how-to-succeed-in-private-practice-tip-2#comment4198196
